These Terms and Conditions may be modified at any time by Regrid Power without notice.
The Guarantee
Regrid Power guarantees that the solar electric system which we have installed at your property will produce the number of kilowatt hours (kWhrs) annually specified in the PowerPledge section of your purchase contract during the ten (10) years that your system is under Regrid Power warranty.
At the anniversary of your service date during the guarantee term, if Regrid determines, in its sole discretion and under these Terms and Conditions of the Regrid PowerPledge Performance Guarantee program, that your system has not produced at least the specified amount of electricity guaranteed, Regrid will compensate you for the lost production at the average cost per kilowatt hour that your utility has charged you for electricity over the preceding twelve months.
Term
The Regrid PowerPledge Guarantee will commence at the later of either the interconnection of your system with your public utility company or the final invoiced payment for your system. The PowerPledge Guarantee will terminate on the tenth (10th) anniversary of its commencement.
Performance Monitoring
Regrid Power will monitor your system daily to ensure that it is producing power as specified. Regrid will provide you access to this same data through an account you may access (your Home Energy Portal) from Regrid’s web site at www.Regrid.com. Regrid will provide you with a log-in and password for this account as part of the PowerPledge program.
Regrid will notify you if our monitoring systems detect a material shortfall in the kilowatt hour production of your system, and may, in its sole discretion, elect to send a maintenance crew to your residence to investigate and resolve any problems it may find. If you deny Regrid access to the system in such an instance, Regrid may suspend your PowerPledge guarantee until such time that your system’s performance can be verified, repaired, and maintained.
If at any time you wish to contact Regrid Power about your system, based on your observations of the monitoring data available through your account, you may contact the Regrid Rapid Response team for further information by using the email form on your account home page. Regrid associates will respond to your inquiry within 36 hours.
Regrid may, in its sole discretion, require you to clean your system’s panels at your expense in order to maintain your good standing in the PowerPledge program. If you do not perform the maintenance required, Regrid may elect to suspend your performance guarantee until it is performed.
Internet Access
As a condition of this guarantee, you agree to permit Regrid to monitor the performance of your system on a continuous basis through the monitoring system Regrid provided with your solar electric system. You further agree to provide access to the Internet, at your sole expense, via Ethernet-protocol, using Category 5 or better wire and a standard 8P8C connector (often referred to as an “RJ-45”). You agree, at your sole expense and effort, to provide such a connection for Regrid Power’s use at the connection point specified in your contract, in any case at least eight (8) inches away, and not more than five (5) feet away, from the inverter installed with your system.
You agree that if for any reason Regrid cannot monitor your system due to an interruption of your Internet service, that Regrid may suspend your PowerPledge until such time that Regrid can fully examine your system.
Your Utility Bill
Regrid does not guarantee the rate, kWh usage, or cost of your utility bill for electricity. Many factors beyond Regrid’s control can affect a customer’s overall electricity expense, including changing usage patterns by residents and the addition of new appliances that increase a property’s overall electricity usage. Regrid does stand behind the production of the solar electric system it has designed and built for you.
Force Majeure
System damage due to weather, other acts of force majeure, or other causes not related to Regrid’s installation of your system, and which may be excluded from Regrid’s installation guarantee and any system component manufacturers’ guarantee, must be repaired at your expense. For the purposes of calculating Regrid’s liability under this guarantee, Regrid will subtract from the annual production guarantee quota the number of kilowatt hours that would have been produced by the system were it not subject to such damage.
Other Exclusions
You agree that shade on your system which results from tree growth that obstructs sunlight and which was not accounted for in your original kilowatt specification must be remedied by your removing enough of the tree growth to eliminate the incremental shade on your system, such removal to be at your sole expense. If you do not remove the incremental growth, Regrid may , at its sole option, elect to either modify your guarantee to take this growth into account, or suspend your guarantee until necessary repair is made to return the system to its original shade coefficient.
You agree that any modification you make to the system without Regrid’s express written consent voids your performance guarantee.
The production data recorded from your system is the property of Regrid Power, and is licensed to you for your personal use.
In case of dispute over these Terms and Conditions, you agree to submit to binding arbitration under the jurisdiction of the State of California and rules of the American Arbitration Association.
